The Start Your Company process is a service screening process. It allows ACS to review basic information about a proposed formation or corporate-service request before determining whether the matter may proceed to full intake, due diligence review, engagement documentation, or registered agent coordination.

If a matter appears suitable to proceed, ACS may invite the client to complete full intake and due diligence through a secure portal or other secure intake process.

6. Client Responsibilities

Anyone submitting information to ACS is responsible for ensuring that the information provided is accurate, complete, current, and not misleading.

Clients and prospective clients are responsible for:

  • Providing complete and accurate information requested by ACS, the registered agent, professional advisers, banks, financial institutions, or relevant authorities.
  • Updating ACS if information changes during screening, intake, due diligence, formation, renewal, amendment, document request, or service coordination.
  • Obtaining legal, tax, accounting, financial, banking, regulatory, or other professional advice where required.
  • Ensuring that the proposed company activity and use of services are lawful and properly disclosed.
  • Responding to requests for clarification, due diligence, supporting documents, or compliance information in a timely manner.
  • Paying required fees, government charges, registered agent fees, professional fees, third-party fees, or service charges when due.

7. Due Diligence, Compliance, and Risk Review

ACS, the registered agent, professional advisers, banks, financial institutions, or other relevant parties may request information and documents for due diligence, compliance, risk review, beneficial ownership review, source-of-funds review, source-of-wealth review, business activity review, sanctions screening, or other required checks.

A request may be delayed, declined, suspended, or terminated if required information is not provided, information is incomplete or inconsistent, concerns arise during review, the activity is outside ACS service scope, or ACS determines that it cannot proceed.

8. Registered Agent and Third-Party Services

ACS may coordinate with these parties where appropriate, but ACS does not control third-party decisions, timelines, requirements, approvals, policies, fees, or outcomes.

9. No Guarantees

ACS does not guarantee incorporation approval, name approval, regulatory approval, registered agent acceptance, banking approval, account opening, tax outcomes, filing outcomes, processing times, certificate issuance timelines, renewal outcomes, amendment outcomes, registry decisions, government decisions, third-party decisions, or business results.

Any timelines stated on the website or in communications are estimates only unless expressly confirmed in writing for a specific matter and subject to all required conditions being met.

10. Banking-Introduction Support
